28 meses, 30 años...

Hoy es 23 de febrero de 2011. Hace 30 años España amaneció con lo que a la postre quedó en susto y en el final definitivo de cualquier aspiración del ejército a salirse de su papel legítimo. Mirando hacia atrás, las cosas han mejorado y al país no lo conoce ni su madre, pero cabe ser escéptico con la famosa Transición.

Hoy es, también, el día que reabre sus puertas el Bogui, tras 28 meses de lo que tiene todo el aspecto de ser un cierre improcedente. Es muy feo citarse a uno mismo (para una vez que acierto...) pero ya dije en su momento que el Bogui reabriría sus puertas. A partir de ahora puede que siga por muchos años, que así sea, o que vuelvan a intentar cerrarlo, o que el desgaste de estar 28 meses sin abrir sea insuperable. En cualquier caso, por mucho que hayamos mejorado desde hace 30 años, y como demuestra el caso del Bogui, España sigue siendo, a la izquierda, a la derecha, arriba y abajo, un país de caciques.

Enhorabuena a Dick Angstadt y a todo el personal del Bogui, ojalá llenen muchas noches, y a seguir peleando.

El Bogui reabre

Una vez superadas todas las exigencias técnico administrativas por parte del Ayuntamiento de Madrid y amparándonos en una nueva licencia de funcionamiento, volveremos a ofrecer actuaciones de música en vivo a principios del próximo mes de Febrero.

Afrontamos esta nueva andadura con ilusión y renovada energía, sabedores de que el colectivo de músicos y los aficionados al jazz estarán deseosos de retomar la senda iniciada a mediados del 2005 y que se vio interrumpida a finales del 2008.

A piece of silver lining / Algo de esperanza

While BoguiJazz is still inexplicably closed, the economic downturn hits Spain hard and the cultural authorities remain ignorant of what's happening today in music on the ground (as opposed to fancy, celebrity-oriented TV), Miguel Rodríguez, a/k/a "Humphrey", from Alcalá de Henares (Spain), in his mid-twenties, was doing this at Smalls in New York City last month.

Mientras el Bogui sigue inexplicablemente cerrado, la crisis económica mundial le da a España la del pulpo y las autoridades culturales siguen ignorando qué ocurre hoy en día en el mundo de la música a pie de obra (nada que ver con el famoseo televisivo), Miguel Rodríguez, alias "Humphrey", complutense, alrededor de 24 años, estaba haciendo cosas como ésta en el Smalls de Nueva York el mes pasado.

El Bogui sigue cerrado / BoguiJazz, still closed

It's going to be a month since BoguiJazz was closed by order of a judge. As of today it is still closed and, worst of all, there's no clear explanation as to the motives. Tomorrow, Thursday 13, at 11:00 (10:00 GMT) the club will have a press conference at their quarters in Calle Barquillo, 29, which should help us know what is going on, at least from the club's point of view.

According to the club, it's still closed because the terms of its licence have been altered by works to sound-proof and adapt the establishment to current municipal standards. Without more details, the question is whether Bogui remains closed due to a real reason (such as structural damage caused to the building caused by said works), or if its closure is due to an administrative error, i. e., to whichever forms not having been filled properly, irrespective of whether the club is fit for purpose or not.

It would seem that the municipal council of Madrid, the Ayuntamiento, is still missing a couple of points. Firstly, jazz clubs, albeit their presumed bad reputation (and reputations are no basis for fair judgements) do have a role in society to spread culture and art, even if as tourist or entertainment attractions. Therefore, it is in the Ayuntamiento's interest to have as many and as good jazz clubs as possible. As private commercial ventures the clubs have to fulfil the applicable rules and standards, as well as whatever the markets dictate, but even so, the Ayuntamiento has room to help promoting this kind of activity.

Secondly, the Ayuntamiento and the claimants should accept that, weird as this may sound, the end result of this whole process will be the re-opening of BoguiJazz. For starters, establishments offering live music are not illegal; not only that, they are necessary in a big city's cultural life, and it is hard to understand that an Ayuntamiento with presumed liberal leanings is not doing its utmost to help reopen an establishment for live music which happens to be one of the good ones. This would help private initiative and improve the culture and arts offerings in Madrid.

Being Spain what it is (what I said earlier about la mala leche), it is also possible that BoguiJazz is being kept closed for as long as possible on a basis of legal and administrative tricks hoping to slowly erode and tire Angstadt and his team out, so they eventually quit completely. The claimants have the right to use any legal resources they can, including tricks if that's what they want, but the Ayuntamiento, as the institution responsible to guard everyone's interests, including Bogui's workers and customers, can't afford to fall into any traps, if that's the game the claimants are playing.

So, BoguiJazz will reopen its doors. Where and when, we don't know, but the Ayuntamiento must facilitate this process. And if there's no real legal impediment to keep the club in its current address, the Ayuntamiento should also be a mediator between neighbours and club, so they can all reach an agreement that's satisfactory for all.

Va a hacer un mes que el Bogui está cerrado por orden judicial. A día de hoy sigue así y lo peor de todo es que no hay una explicación clara sobre el motivo del cierre. Mañana, jueves 13, la dirección del club celebrará una rueda de prensa en su sede de la C/ Barquillo 29, a las 11:00, lo que debería servir para que sepamos qué está pasando, aunque sea desde el punto de vista del club.

Según la propia dirección del establecimiento, éste sigue cerrado porque "la licencia de funcionamiento de BoguiJazz ha sido alterada por obras de insonorización y adaptación a ordenanzas actuales". A falta de más información, la pregunta es si el Bogui sigue cerrado por una razón real (como serían unos daños estructurales al inmueble a causa de dichas obras), o si su cierre se debe a un defecto administrativo, a que el papeleo no se ha cumplimentado debidamente, vaya, independientemente de que el club esté en condiciones de funcionar.

Parece que el Ayuntamiento de Madrid sigue sin darse cuenta de dos cuestiones: una, que los clubes de jazz, por mala reputación que tengan (y sobre reputaciones no se hacen juicios justos), tienen una función social de difusión de la cultura e incluso de atracción turística o de ocio y, por tanto, le interesa al Ayuntamiento que la ciudad de Madrid cuente con buenos y abundantes clubes de jazz. Como establecimientos comerciales privados, han de estar sujetos a las normativas correspondientes y a los dictados del mercado, pero aun con esas dos salvedades el Ayuntamiento tiene margen para apoyar este tipo de actividad.

La segunda cuestión que el Ayuntamiento y los denunciantes deberían asumir que, por raro que suene, el resultado de todo este proceso es que BoguiJazz volverá a abrir sus puertas. Para empezar, los establecimientos que ofrecen música en directo no son ilegales; pero es que además son necesarios en la vida cultural de una ciudad, y por eso es francamente incomprensible que un Ayuntamiento al que se le supone cierta inclinación liberal no esté haciendo más por facilitar la reapertura de un excelente establecimiento de música en directo. Aparte de que se trata de fomentar la iniciativa comercial privada, también se trata de mejorar la oferta cultural de Madrid.

Siendo España el país que es, también cabe la posibilidad de que se esté intentando mantener BoguiJazz cerrado el mayor tiempo posible a base de subterfugios y argucias administrativas con la esperanza de que por puro desgaste o cansancio Angstadt y los suyos tiren la toalla. Los denunciantes están en su derecho de recurrir a todas las artimañas legales a su alcance si eso es lo que quieren, pero el Ayuntamiento, como institución que ha de velar por los intereses de todos sus ciudadanos, y eso incluye a los trabajadores y clientes de BoguiJazz, no puede permitirse caer en ese juego, si es eso lo que está sucediendo.

BoguiJazz volverá a abrir sus puertas. Cuándo y dónde, no se sabe, pero el Ayuntamiento tiene la obligación de facilitar ese proceso. Y si no hay verdadero impedimento legal para que siga siendo en el número 29 de la calle Barquillo, debería mediar entre vecinos y club para que se llegue a un acuerdo satisfactorio para todos.

A taste of bad milk / El Bogui, cerrado

First of all, apologies for the unannounced raincheck. These are hectic times for me and I'm not being able to "feed the beast" (i. e., add more junk to the internet) as regularly as I would like to. Readers of this blog can always visit the ones I recommend on the right hand-side. They're certainly more regular than mine. In any case, the main news I've had on jazz have been deaths (especially sorry to hear about Neal Hefti's - I'm a big fan of his work for Woody Herman's First Herd) and similar catastrophes.

So... the bad milk. In Spanish, "la mala leche", literally. That means something somewhat alien to non-Spaniards. It's a deep-rooted will to make someone suffer. You can do someone wrong, but "a mala leche" has that extra bit of cruelty and sadism that Goya captured so well in his darker works.


And Bogui? "El Bogui" (official name, BoguiJazz) is a jazz club in Madrid. Ask the local jazz fans and they will almost certainly recommend it. "The only 100% jazz establishment in Madrid", jam sessions included. The blurb in their website states that they try to be a bit of NY (the lofts, Smalls...) in Spain. Not sure about whether they achieve that, but it doesn't seem such a bad approach.

On Tuesday at noon the police shut down the club, following an order issued by a Higher Court ("Tribunal Superior"). According to the report in the daily newspaper "El Mundo", there'd be little base for this, and the dispute between Dick Angstadt, the 67-year old club owner, and his neighbours looks more like a long-winding row about having a jazz club downstairs from home, rather than any noise-levels or disturbances that may have been actually caused.

I don't know who's in the wrong here, and it's likely not a simple matter. But to have a club shut down by the city Council, the same Council providing funds to this and other clubs for the Madrid Jazz Festival beginning next week (hence the "mala leche"), strikes me as a bit surreal; it actually reminds me of a ruling in the early 1990s by which a dispute between the DelTonos, an excellent Spanish blues-rock band, and their label, was resolved with the group banned to play live and, after they ignored that ruling, a second one labelled them "intellectualy dangerous". The affair was a waste of time and money - eventually the label disappeared (not without having released two unauthorised albums) and the band is still playing.

In any case, this is a sad story and it does look bad. Let's hope for the best and for some good will that allows Bogui to open its doors in November.

En primer lugar, disculpas por la larga ausencia. Lo cierto es que no estoy pudiendo "alimentar a la bestia" tan regularmente como quisiera. En todo caso, a la derecha están los enlaces recomendados para quien se aburra. Además, las noticias que he tenido han sido generalmente de fallecimientos (especialmente el de Neal Hefti, de quien admiro su trabajo para el primer rebaño de Woody Herman).


A lo nuestro: en vísperas del festival de jazz de Madrid, el Ayuntamiento de Madrid ha cerrado el Bogui. Por orden judicial. Precisamente estos días se habla de los problemas de la administración de justicia, de los retrasos, de la falta de medios... ya es casualidad que hayan tenido que cerrar el club en vísperas del festival de jazz de Madrid. Casualidad, o la proverbial mala leche española.

Están el jazz y la cultura en general en España como para permitirse el lujo de perder un buen club de jazz, de música improvisada, de una forma de expresión artística. Todavía habrá algún ignorante que crea que todos los gatos son pardos, y que quien sale de noche o bebe es un delincuente en potencia. O que el jazz no es música. Pero quizás sólo se trate de eso, de mala leche.

De momento sólo se conoce públicamente una versión de la historia, la del dueño del club, pero esto tiene todo el aspecto de ser una pugna por cerrar un club, independientemente de los niveles de ruido o de las molestias reales que esté causando.

Esperemos que se llegue a un acuerdo y el Bogui pueda abrir sus puertas para el festival de Madrid.
